Real Estate Sale: Single or exclusive mandate, which to choose?

Some homeowners even use a number of agencies to sell their property. Two types of contracts available to them: simple mandate or exclusive mandate. Most French opt for the first, but do they really right?
Today, nearly 70% of owners who wish to sell their home through a real estate agency opt for the term "simple", which leaves more freedom to the seller compared to the exclusive mandate. But have they really right? Not sure.

The simple term, less restrictive but more hazardous

The simple term is one that provides the most freedom. It allows the seller to entrust the sale of his property to one or more intermediaries, while leaving the possibility to conclude a transaction with the owners, that is to say, with the potential buyer that he found by his own (word of mouth, ads on websites as Leboncoin.fr etc.). Do not forget to prevent or agencies if the sale is made by you.
If the seller has signed a non-exclusive contract with several intermediaries, the agency concluded the sale which perceives the commission (on average 5% of the sale price), paid by the purchaser. However, it is recommended that mandated that three professional at most, to avoid confusion among potential buyers, especially if the property is offered at different prices.
The lowest involvement of agencies is one of the most frequently cited drawbacks. Indeed, we consider that an intermediary will probably invest less in sales compared to an exclusive, knowing that the property in question is entrusted to several agencies and that the commission can escape.
Another deterrent, "the time of the sale, which is 98 days on average" according to Olivier Alonso, president of the real estate network Solvimo-4636 / "> Solvimo .com /"> Solvimo -4636 / "> Solvimo (140 agencies France). Moreover, "a good single term sells on average in 110 days against 72 days in the exclusive mandate. This delay is even reduced to 60 days for the two branch networks Solvimo -4636 / "> Solvimo and Avis Immobilier," the professional. In other words, entrust the exclusive right to sell its properties to a single agency reduces half sales period.
Advantages :
> More freedom: the seller may transfer its housing without going through an agency, and the contract can be terminated with 15 days notice.
> More visibility: the property will be visible in several agencies and listings available on various specialized sites.
The inconvenients :
> More low involvement of agencies in competitive tenders.
> Possible confusion among potential buyers: prices sometimes well as different agencies.
> Selling time usually longer than exclusive mandate.

The exclusive mandate more efficient but more constraining

The exclusive mandate is praised by 30% of households. Yet this type of contract that leaves the exclusive good for one real estate agency has a number of advantages. Reminder: as part of an exclusive, the seller agrees not to sell his house or apartment owners, and redirect to its intermediary any potential buyer that he himself would have flown.
The exclusive property is defined generally for a period of 3 months. Nevertheless, it is possible to negotiate the length of this period, leaving the seller leeway in case the transaction fails at the end of 90 days for x or y reasons. Note that an exclusive mandate can not be terminated prematurely. But by definition, the realtor will put the odds on his side to the transaction to be concluded quickly and at the best price.
Grant exclusivity to an agency "allows a single source, which avoids having such key issues for visits made during the day," said Olivier Alonso, network Solvimo -4636 / "> Solvimo . Furthermore, the property is not overexposed with prices and descriptions of various other benefits according to the executive. the actual development of his property by the professional (high-definition photos, homestaging ...) or the price of the transaction that will be "higher than simple mandate."
Advantages :
> Most important investment of the agency to find candidates for purchase.
> Better visibility thanks to the different agencies and media networks in exclusive mandate, the agency will not hesitate to put the property value, eg in the window.
> Simpler management for the owner with a single contact, including the organization of visits and key collection.
> Miscellaneous Promotions can include ads in the window or the real diagnoses offered: Mandatory prior to the sale or lease, these reports (asbestos, lead, ECD etc.), usually borne by the owner or lessor cost a few hundred euros. Significant savings ...
> Sale usually faster than simple mandate.
The inconvenients :
> Flexibility Cons: during the period of exclusivity, you agree not to entrust mandate to another intermediary, and if you find a buyer yourself, you will need to contact your agent ... under penalty of having to pay damages to the agency.
After a period of three months (or the period agreed at the time signature), the exclusive mandate can be terminated at any time by either party by registered letter with acknowledgment of receipt, subject to a notice period of 15 day minimum.
Note that it is possible to add a clause in the contract allowing the seller to complete a transaction with a potential purchaser, provided that he has not been in contact with the agency. Not sure, however, that the agency agrees and if it does, the degree of investment in sales may suffer ...
